ABOUT THESE TERMS
These Terms of Use govern your use of peritik.com and anything you buy from us through it. The site is operated by Peritik, LLC, a family-run business in Concord, California.
By using this site or placing an order, you agree to these Terms. If you do not agree, please do not use the site.
WHO MAY USE THIS SITE
You must be at least 18, or old enough to enter a contract where you live, to place an order. If you are younger, you may use the site only with a parent or guardian who accepts these Terms.
OUR PRODUCTS
We sell natural stone jewelry, hats, bags, and home accessories.
Natural stone varies, and that is not a defect. Colour, pattern, veining, and size differ from piece to piece, and the same stone can look different in different light. Photographs show a representative piece, not the exact one you will receive, unless we say otherwise. Screens also render colour differently. Variation is the nature of the material.
We describe stones by their trade names and their traditional or cultural associations only. Nothing on this site is a claim that any stone or material treats, cures, prevents, or affects any medical or psychological condition. Our products are decorative accessories. If you have a health concern, talk to a qualified professional.
Hats are sized by measurement. Please use our sizing guides. Fit varies between styles and between makers.
PRICES AND AVAILABILITY
Prices are in US dollars and may change without notice. We try hard to describe and price everything accurately, but errors happen. If we discover an error in the price or description of something you ordered, we will contact you before shipping and you may confirm the order at the correct price or cancel it for a full refund.
Availability is not guaranteed. We sell the same stock in person at markets, so an item can sell out between your order and our packing it. If that happens we will tell you and refund you in full.
ORDERS
Your order is an offer to buy. We accept it when we ship it. We may refuse or cancel any order, including after you receive a confirmation, if an item is unavailable, if we cannot verify payment or your shipping address, or if we suspect fraud. If we cancel, we refund in full.
Shipping is covered by our Shipping Policy. Returns and exchanges are covered by our Returns & Exchanges Policy. Cancellations are covered by our Cancellation Policy. Those policies form part of these Terms.
BUYING FROM US IN PERSON
We sell at pop-up markets across Northern California. Purchases made in person are governed by the Returns & Exchanges Policy, which treats them differently from online orders. Our published event schedule is our current plan, not a guarantee — weather, venue decisions, and organiser changes can move or cancel a date.
YOUR ACCOUNT
If you create an account, keep your password to yourself and tell us promptly if you think someone else is using it. You are responsible for activity under your account.
REVIEWS AND ANYTHING YOU POST
If you send us a review, photograph, or comment, you keep ownership of it, and you give us permission to display and share it in connection with our products and our business. Please only send us material you made or have the right to share, and nothing unlawful, misleading, or abusive. We may decline to publish or may remove anything, but we do not edit reviews to change their meaning.
OUR CONTENT
The Peritik name, our parrot logo, our product photography, and our written content belong to us. Please do not copy or reuse them commercially without our written permission. You are very welcome to share our pages and link to us.
ACCEPTABLE USE
Please do not use this site to break the law, to scrape or harvest data at scale, to interfere with the site's operation or security, or to resell our products in a way that misrepresents them as yours.
LINKS TO OTHER SITES
We sometimes link to sites we do not control. We are not responsible for their content or their privacy practices.
DISCLAIMERS
The site and our products are provided "as is." To the fullest extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise the site will be uninterrupted or error-free.
Nothing here limits any right you have that cannot be limited by law, including rights under California consumer protection law.
LIMITATION OF LIABILITY
To the fullest extent the law allows, Peritik is not liable for indirect, incidental, special, or consequential damages. Our total liability for any claim relating to an order will not exceed what you paid for that order.
Some jurisdictions do not allow these limits, in which case they do not apply to you.
INDEMNIFICATION
You agree to cover our reasonable costs if a claim arises from your misuse of the site or your breach of these Terms.
DISPUTE RESOLUTION AND ARBITRATION
Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court.
Talk to us first. Most problems are faster to fix directly. Email contact@peritik.com and give us 30 days to resolve it before starting a formal proceeding.
Arbitration. Except for the disputes described below, you and Peritik agree that any dispute arising out of or relating to these Terms, your use of peritik.com, or anything you buy from us will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. Judgment on the award may be entered in any court with jurisdiction. This provision is governed by the Federal Arbitration Act.
Small claims. You may instead bring an individual claim in small claims court if it qualifies under that court's rules and stays there.
Excluded disputes. Claims about intellectual property — trademarks, domain names, trade secrets, copyrights, patents — are not subject to arbitration.
No class actions. You and Peritik each agree to bring claims only individually, and not as a plaintiff or class member in any class, consolidated, or representative proceeding.
You can opt out. Arbitration is not mandatory. If you tell us within 30 days of first accepting these Terms, this entire section will not apply to you, and nothing else about your relationship with us changes. Send your name, address, the email on your order, and a clear statement that you are opting out of arbitration to Peritik, LLC, ATTN: Arbitration Opt-out, 785 Oak Grove Rd E2 6004, Concord, CA 94518 — or email contact@peritik.com with "Arbitration Opt-out" as the subject.
Where disputes go otherwise. If this section does not apply — because you opted out, because the dispute is excluded, or because a court finds arbitration unenforceable — you and Peritik agree that the dispute will be resolved exclusively in the state or federal courts located in Contra Costa County, California, and you consent to personal jurisdiction there.
Severability. If any part of this section is found unenforceable, the rest stays in effect, except that if the class-action waiver is found unenforceable, this entire arbitration section does not apply.
GOVERNING LAW
California law governs these Terms, without regard to its conflict-of-laws rules.
CHANGES
We may update these Terms. The version posted here, with its effective date, is the one that applies. If we make a material change we will post it before it takes effect.
