The Privacy Policy also applies to our fashion marketing and sales activities, including sales through our stores in the United States and Canada under our brands Peritik, Peritik Jewelry.
In this Privacy Policy, the terms "Peritik," "we," and "us" refer to Peritik, LLC, and its respective subsidiaries and affiliated companies. The term "your device" refers to any computer, tablet, smartphone, or other device you use to access our websites or operate Peritik mobile applications. Sites owned and operated by Peritik may contain links to websites owned and operated by other companies. This Statement does not apply to websites and services owned and operated by third parties.
We understand the importance of privacy to our customers and have designed this Privacy Policy to describe our information collection and dissemination practices. You accept this Privacy Policy when: 1) you access or use any Site; and/or 2) you agree to receive our emails. If you do not agree with this Privacy Policy, do not use this Site.
This Privacy Policy was effective on the date noted above. Please note that we reserve the right to revise and update this Privacy Policy from time to time. Information Collected from Our Partners: We may partner with third-party resellers to receive information about you, such as your name and contact information. This helps us fulfill your service requests and/or provide you with services that may interest you.
COOKIES AND OTHER TRACKING TECHNOLOGIES WE USE
We and our service providers use cookies, beacons, embedded scripts, and local shared objects in connection with the Sites.
- Cookies are small text files stored on your computer or device when you visit our websites. Cookies allow a website to recognize a particular device or browser. The use of cookies is a standard practice among websites to collect information about visitors' activities while using the website.

Third-Party Analytics: We may also use service providers, such as Google Analytics, that may use cookies or other technologies to collect information about your online activities on this and other sites over time for non-advertising purposes as described above. Google Analytics: To help deliver relevant content, we use Google Analytics and have implemented the following Google advertising features: remarketing, impression reports, and demographics and interest reports. We use Google Analytics cookies and other Google advertising cookies. You can opt out of Google Analytics' advertising features by indicating your preference using the opt-out link here. OUR OPT-OUT POLICY

Promotional Emails: To stop receiving our newsletters or marketing communications or to opt-out of sharing your email address with third parties, use the "unsubscribe" mechanism provided in the communication (such as the "unsubscribe" link at the bottom of the marketing email) or send an email to contact@peritik.com with the necessary information to process your request.
Service-Related Announcements: We will also send you service-related announcements by email on rare occasions when it is necessary to do so. For example, if our service is temporarily suspended for maintenance, we might send you an email. You do not have the option to opt-out of these emails, which are not promotional in nature.
OUR POLICY FOR CORRECTING AND UPDATING PERSONAL INFORMATION AND DEACTIVATING YOUR ACCOUNT
You can request to access, correct, update, or delete your personal information, or deactivate your account, by emailing our Customer Support at contact@peritik.com with the necessary information to process your request. We will respond to your request to access your personal information within 30 days. We may need to verify your identity before granting access to the personal information in our custody or control. CALIFORNIA RESIDENTS
Your California Privacy Rights: Peritik collects the information you provide or that we learn about you through your use of our websites or your purchases in our stores as described in this Privacy Policy. Under California law, once a year, Peritik customers who are California residents may request certain information about our disclosure of personal information to unaffiliated third parties for their direct marketing purposes. Peritik does not disclose any personal information to unaffiliated third parties for these purposes.

EU RESIDENTS

Blogs and Public Features of the Sites: Some of our Sites offer publicly accessible blogs, community forums, or public comment sections. You should be aware that any personal information you submit there may be read and collected by other users of these forums and could be used to send you unsolicited messages and for other purposes. Our blog and comment section are managed by a third-party application that may require you to register to post a comment. We do not have access to or control the information posted in the blog. NONE OF THE INFORMATION YOU PROVIDE USING THESE FEATURES IS PROTECTED BY THIS PRIVACY POLICY. WE ARE NOT RESPONSIBLE FOR THE PERSONAL INFORMATION YOU CHOOSE TO SUBMIT IN THESE FORUMS OR THE USE OF THAT INFORMATION BY THIRD PARTIES. Social Media Widgets: Our Sites may include social media features, such as the Facebook Like button and widgets such as the Share This button or interactive mini-programs running on our Sites. These features may collect your IP address, which page you are visiting on our Sites, and may set a cookie to enable the feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly on our Sites. Your interactions with these features are governed by the privacy policy of the company providing them.

Assignment: In the event that all or part of our assets are sold or acquired by another party, or in the event of a merger, you grant us the right to assign the personal and non-personal information collected via the Sites.
Disputes, Arbitration Agreement, and Choice of Law: By using the Sites, you and Peritik agree that if there is any controversy, claim, action, or dispute arising out of or related to your use of the Sites, or the breach, enforcement, interpretation, or validity of this Privacy Policy or any part of it (“Dispute”), both parties will first try to resolve such Dispute in good faith by providing written notice to the other party describing the facts and circumstances of the Dispute and allowing the receiving party 30 days to respond to or resolve the Dispute.

Both you and Peritik agree that this dispute resolution procedure is a condition precedent that must be satisfied before initiating any litigation or filing any claim against the other party. IF ANY DISPUTE CANNOT BE RESOLVED THROUGH THE ABOVE DISPUTE RESOLUTION PROCEDURE, YOU AGREE THAT THE SOLE AND EXCLUSIVE JURISDICTION FOR SUCH DISPUTES WILL BE DECIDED BY BINDING ARBITRATION ON AN INDIVIDUAL BASIS. BINDING ARBITRATION ON AN INDIVIDUAL BASIS MEANS THAT YOU WILL NOT HAVE, AND YOU WAIVE, THE RIGHT TO A JUDGE OR JURY DECIDE YOUR CLAIMS, AND THAT YOU MAY NOT PROCEED IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE CAPACITY. Other rights that you and we would have in court will not be available or will be more limited in arbitration, including the right to discovery and appeal. All such disputes shall be submitted exclusively to JAMS (www.jamsadr.com) for binding arbitration under its rules then in effect before one arbitrator mutually agreed upon by both parties.
The arbitrator, and not any federal, state, or local court or agency, shall have exclusive authority to resolve any dispute arising out of or relating to the interpretation, applicability, enforceability, or formation of this Privacy Policy, including any claim that all or any part of this Privacy Policy is void or voidable.
This Privacy Policy has been made and shall be construed in accordance with the laws of the State of California, without giving effect to any conflict of legal principles. The parties acknowledge that this Privacy Policy evidences a transaction involving interstate commerce. Notwithstanding the foregoing regarding substantive law, any arbitration conducted under the terms of this Privacy Policy shall be governed by the Federal Arbitration Act (9 U.S.C. §§ 1-16).
